Peter Masucci v. Judy's Moody, LLC et al.

In a series of orders, the Superior Court (O'Neil, J.) denied or dismissed (1) the requests of the Attorney General and several individuals for a judgment declaring that the public has a right to use the intertidal land owned by several entites and individuals at Moody's Beach in Wells and (2) the requests by several individuals for a judgment declaring that the State of Maine owns all intertidal land in the state that it has not alienated.

Virtually every party appealed. The Clerk of the Law Court docketed the appeals as Peter Masucci et al. v. Judy's Moody, LLC, et al., Law Court docket number Cum-24-82.

The Maine Judicial Branch has set up this web page to post information on the appeal. This ensures the public's full access to information related to the proceeding. It is our goal to accommodate the media and the public to the best of our abilities.

All public documents will be provided here and will not be provided by the clerk's office. Please check this web page often for updates and documents related to the case.

Case information and public documents below will be removed from the website once the case is no longer active or considered of great interest to the media and the public.
